IF YOU DO NOT AGREE TO THE TERMS PRESENTED IN THIS LICENSE, THEN PC Utilities, INC. (HEREINAFTER "Pc Utilities Inc") DOES NOT GRANT CONSENT TO LICENSE THE ErrorFix SOFTWARE TO YOU AND YOU CANNOT USE THE SOFTWARE. BY DOWNLOADING INSTALLING, COPYING, OR OTHERWISE IMPLEMENTING THE SOFTWARE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THESE CONDITIONS.

1. SOFTWARE LICENSE

The "PC Utilities Inc" programs and/or software (respectively "'PC Utilities Inc' Program[s]" or "program[s]"), the documentation for said software and all fonts accompanying this License, whether they appear on disk, on read- only memory, on other media or in any other form, are licensed to you by "PC Utilities Inc." The media on which the program(s) is recorded is owned by you but "PC Utilities Inc" retains the title to the "PC Utilities Inc" Program(s). The "PC Utilities Inc" Program(s) and copies that this License authorizes you to make are explicitly subject to this License.

2. RESTRICTIONS

This License authorizes you to install and implement the "PC Utilities Inc" Program(s) on your private computer. Any "PC Utilities Inc" Program(s) that are saved or archived must include complete copyright information and respective License documentation contained in the original. You are forbidden in whole or part to disassemble, decompile, modify, reverse engineer, rent, lease, distribute, or make commercial use of, or create works derived from the "PC Utilities Inc" Program(s). If you fail to comply with any term(s) of this License, the rights you maintain under this License shall terminate automatically without notice from "PC Utilities Inc."

The "PC Utilities Inc" Program(s) is only available for personal, non-commercial use. Use of "PC Utilities Inc" Program(s) for any purposes other than personal use is forbidden.

3. LEGAL COMPLIANCE

In order to use the "PC Utilities Inc" Program(s), you agree to comply with all regulations and laws applicable to your personal use of "PC Utilities Inc" Program(s), including (but not limited to) regulations and laws concerning US and international copyright & intellectual property, possession and distribution of child pornography, obscenity, violence against racial and/or gender groups, and other prohibited materials pursuant to federal, state and local laws.

You hereby acknowledge that any images, depictions, portrayals or other representation of public events and personalities, qualify as a "fair use" and/or "parody" under state, federal and international definitions thereof.

You acknowledge that "PC Utilities Inc" Program(s) is a personal search tool and may NOT be used to:

- Harm minors in any way;
- Intentionally or unintentionally violate any applicable local, state, national or international law, including securities exchange and any regulations having the force of law;
- Collect and/or store personal data about other users.

You acknowledge and agree that "PC Utilities Inc" reserves the right to preserve content and may also disclose content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonable necessary to:
(a) enforce this Agreement;
(b) comply with legal due process;
(c) respond to claims that content violates rights of third-parties; or
(d) protect rights, property, and/or safety of "PC Utilities Inc", its users and the public.

4. UPDATE ACKNOWLEDGEMENT

You acknowledge that the "PC Utilities Inc" Program(s) includes technology allowing "PC Utilities Inc" to provide updates to the software stored on your computer. By downloading, installing, updating, copying or otherwise using the "PC Utilities Inc" Program(s), you hereby agree to accept and/or include the aforementioned technology by means of which "PC Utilities Inc" keeps "ErrorFix" up-to-date. Note that ErrorFix permits the user to select the method of updating the definition database. There are three (3) methods:

1 to download updates automatically and notify the user when it is ready for install.
2 to notify the user when an update becomes available but only download it if the user clicks, "install."
3 to disable automatic updates and thereby require the user to implement updates manually.

Upon installation, the second option (2) is set to the default.

5. LIABILITY DISCLAIMER

"PC Utilities Inc" WILL, IN NO EVENT, BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE "PC Utilities Inc" PROGRAM(S).

"PC Utilities Inc" WILL, IN NO EVENT, BE LIABLE FOR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR DEFAMATION, NEGLIGENCE, COPYRIGHT OR ANY OTHER CLAIMS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE "PC Utilities Inc" PROGRAM(S).

"PC Utilities Inc" WILL, IN NO EVENT, BE LIABLE FOR THE DELAY OR INABILITY TO USE THE "PC Utilities Inc" PROGRAM(S) , THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE "PC Utilities Inc" PROGRAM(S) OR OTHERWISE ARISING FROM THE USE OF THE "PC Utilities Inc" PROGRAM(S), REGARDLESS OF WHETHER THEY BE BASED ON TORT, CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF USER HAS BEEN NOTIFIED OF THE POSSIBILITY OF DAMAGES.

CERTAIN STATE LAWS DISALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, AND/OR LIMITATIONS MAY NOT BE APPLICABLE TO YOU.

IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE "PC Utilities Inc" PROGRAM(S) , OR WITH ANY OF THESE TERMS OF USE, YOUR EXCLUSIVE REMEDY IS TO DISCONTINUE THE USE OF "PC Utilities Inc" PROGRAM(S) .

6. WARRANTY DISCLAIMER

YOU AGREE THAT "PC Utilities Inc" PROGRAM(S) ARE PROVIDED "AS IS" AND "AS AVAILABLE". "PC Utilities Inc" DOES NOT MAKE ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, IMPLIED OR EXPRESSED, CONCERNING THE OPERATION OF "PC Utilities Inc" PROGRAM(S), THE USE SAID PROGRAMS, OR THE RESULTS OF THE USE OF SAID PROGRAMS.

YOU AGREE THAT PERSONAL USE OF THE "PC Utilities Inc" PROGRAM(S) IS AT YOUR SOLE RISK. "PC Utilities Inc" DISCLAIMS, TO THE EXTENT PERMITTED BY LAW, ANY AND ALL EXPRESSD, IMPLIED, AND STATUTORY WARRANTIES; THESE INCLUDE WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY, THOSE OF FITNESS FOR A PARTICULAR PURPOSE, AND THOSE OF NON-INFRINGEMENT OF PROPRIETARY RIGHTS. THE WARRANTIES FOR SERVICES OR GOODS RECEIVED BY MEANS OF "PC Utilities Inc" PROGRAM(S) OR PROVIDED BY THE "PC Utilities Inc" WEB SITE OR ANY USE OF THE "PC Utilities Inc" PROGRAM(S).

THE WARRANTIES THAT "PC Utilities Inc" PROGRAM(S), THE "PC Utilities Inc" SERVERS, OR E-MAIL SENT FROM "PC Utilities Inc" ARE FREE OF VIRUSES AND/OR OTHER HARMFUL COMPONENTS.

CERTAIN STATE LAWS DISALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, AND/OR LIMITATIONS MAY NOT BE APPLICABLE TO YOU.
